What Is a Nil GST Return?

A Nil GST Return is a GST return filed for a tax period in which the registered taxpayer had zero outward supplies (sales), zero inward supplies (purchases), and zero tax liability. It is a declaration to the government that no business activity occurred during that period.

This is one of the most misunderstood compliance requirements in India. Many business owners assume that if they have no sales, they have no filing obligation. This is incorrect — and it is the assumption that generates thousands of GST penalty notices every month.

The law under the CGST Act, 2017 is clear: a GST-registered taxpayer must file all applicable returns for every tax period — regardless of whether there was any business activity. A zero-transaction period requires a Nil return, not silence.

Important:

Nil GST Return filing is applicable to GSTR-1 (outward supplies return), GSTR-3B (monthly summary return), and CMP-08 (for composition dealers). Each has its own due date — and each attracts a separate penalty for late filing.

Who Needs to File a Nil GST Return?

Every GST-registered person who meets the following conditions for a given tax period must file a Nil return:

  • No outward supplies (sales / invoices issued) during the period
  • No inward supplies (purchases) attracting reverse charge
  • No Input Tax Credit (ITC) to claim or adjust
  • Zero tax payable and zero tax collected
  • No amendments or adjustments to carry forward

This includes sole proprietors, partnership firms, Private Limited Companies, LLPs, and any other entity that holds an active GSTIN — even if the business is temporarily inactive, seasonal, or in a pre-revenue startup phase.

If you have recently obtained GST Registration and have not yet started operations, you are still required to file Nil returns from the month of registration until your first taxable supply.

Nil GST Return Due Dates — 2026

Due dates for Nil returns are the same as for regular GST returns. Missing them triggers penalties even when there is zero business activity.

How to File Nil GSTR-1 Online — Step by Step

GSTR-1 is the return for outward supplies. For a Nil period, all tables will remain blank. Here is the complete process:

  1. Log In to the GST Portal

Open gst.gov.in in your browser. Click Login at the top right. Enter your GSTIN or Username and Password. Complete the CAPTCHA and click Login.

Tip: Use Chrome or Firefox for the best portal compatibility. Avoid Internet Explorer.
  2. Navigate to Returns Dashboard

From the top navigation, click Services → Returns → Returns Dashboard. The Returns Dashboard shows all pending and filed returns for your GSTIN.

  3. Select Financial Year and Tax Period

Choose the correct Financial Year (e.g., 2025–26) and the Tax Period (month or quarter) for which you are filing the Nil return. Click Search.

Tip: Always confirm the period before filing. A return filed for the wrong period cannot be revised easily.
  4. Click on GSTR-1 Tile

On the Returns Dashboard, you will see the GSTR-1 tile. Click Prepare Online. The portal will open the GSTR-1 form with all tables available for data entry.

  5. Confirm Nil Return and Generate Summary

Since there are no outward supplies, do not enter data in any table. Scroll to the bottom and click Generate GSTR-1 Summary. All figures will show as zero. Review and confirm the summary.

  6. Submit and File GSTR-1

Click Submit. The portal will ask you to confirm the declaration. After submission, click File GSTR-1 and verify using either EVC (OTP on mobile) or a DSC (Digital Signature Certificate) for companies and LLPs.

Tip: Companies and LLPs must use DSC for filing. Proprietors and individuals can use EVC (Aadhaar OTP).
  7. Download the ARN Confirmation

After successful filing, the portal generates an ARN (Acknowledgement Reference Number). This is your proof of filing. Download and save it. You will also receive an SMS and email confirmation on your registered mobile and email.

How to File Nil GSTR-3B Online — Step by Step

GSTR-3B is the monthly or quarterly summary return where you declare tax liability and ITC. For a Nil period, all tax fields will be zero. The process follows immediately after filing GSTR-1.

  1. Return to the Returns Dashboard

After filing GSTR-1, go back to Services → Returns → Returns Dashboard and select the same financial year and tax period.

  2. Click on GSTR-3B Tile

Click Prepare Online on the GSTR-3B tile. The form will open with all tax fields set to zero since no GSTR-1 data has been pushed through.

  3. Confirm All Tables as Zero

In Table 3.1 (Outward Supplies), Table 3.2 (Inter-State Supplies), Table 4 (ITC), and Table 5 (Exempt Supplies) — all values should remain zero. Do not enter any figures.

Tip: The portal may auto-populate from GSTR-1. Verify each table shows zero before proceeding.
  4. Save and Preview

Click Save GSTR-3B. Then click Preview Draft GSTR-3B to download a PDF of the Nil return for your review before final submission.

  5. Make Payment (₹0) and File

Since tax liability is zero, click Payment of Tax. The cash and credit ledger will show zero. Proceed to File GSTR-3B and verify using EVC (OTP) or DSC. The Nil return is now filed.

  6. Save Your ARN

Download the GSTR-3B ARN confirmation. Your Nil return for this period is now complete. The portal will update your filing status from Pending to Filed.

File Nil GST Return via SMS — The Quick Method

The GST department offers an SMS-based Nil filing facility for taxpayers who want to file quickly without logging into the portal. This is available for both GSTR-1 and GSTR-3B Nil returns.

Step 1 — Send SMS for GSTR-1 Nil Filing:

NIL 1 GSTIN TAX-PERIOD

Example: NIL 1 29AABCU9603R1ZX 032026 (for March 2026)

Step 2 — Send SMS for GSTR-3B Nil Filing:

NIL 3B GSTIN TAX-PERIOD

Example: NIL 3B 29AABCU9603R1ZX 032026 (for March 2026)

Send both SMS messages to: 14409
From your mobile number registered with the GST portal.

After sending, you will receive a confirmation code via SMS. Reply with that code to complete the filing. The system sends a final ARN confirmation once the return is successfully filed.

SMS Nil Filing Conditions:

SMS filing is only available when all tables in the return are Nil. If even one invoice or ITC entry exists for the period, you must use the portal. SMS filing is not available for composition dealers (use portal for CMP-08).

Penalty for Late Filing of Nil GST Return

Many businesses assume a Nil return has no consequence if filed late — because there is no tax to pay. This is a costly misconception. The GST Act levies a specific penalty for late Nil return filing, separate from the regular late fee structure.

Late fee for Nil GSTR-1 ₹20/day (₹10 CGST + ₹10 SGST)
Late fee for Nil GSTR-3B ₹20/day (₹10 CGST + ₹10 SGST)
Maximum late fee per return ₹500 (₹250 CGST + ₹250 SGST)
Consecutive non-filing (6 months) GST Registration Cancellation
Interest on tax (Nil period) Nil (no tax liability)

While ₹500 may seem small, the real risk of consistent non-filing is suo motu cancellation of your GST registration by the GST officer — which can affect your ability to conduct business, issue invoices, and claim ITC. Revocation after cancellation is possible but involves additional compliance burden.

If your GST registration has been cancelled and you need to restore it, our experts can assist with the revocation process. You can also explore our GST Cancellation and related compliance services.

5 Common Mistakes When Filing Nil GST Returns

Wrong Tax Period Selected

Filing Nil return for the wrong month or quarter is one of the most common errors. Always double-check the Financial Year and Tax Period before submission.

Filing GSTR-3B Without GSTR-1

GSTR-1 must always be filed before GSTR-3B for the same period. Filing out of sequence causes mismatches in the portal's auto-population.

Skipping the ARN Download

Not saving the ARN confirmation leaves you without proof of filing. Always download and store the ARN for each return period.

Using Wrong Verification Method

Companies and LLPs must use DSC. Using EVC for a company return will result in filing failure. Confirm your entity type before selecting the verification method.

Assuming No Activity = No Filing

The most expensive mistake. Zero business activity does not mean zero filing obligation. Every active GSTIN must file for every period — Nil or otherwise.

Missing Backdated Nil Returns

If you have missed Nil returns for previous months, file them immediately. Late fees accumulate daily. Clearing the backlog promptly minimises total penalty liability.
