When someone other than the applicant files an application, answers an examination report or appears at a hearing, the Registry needs written proof that the person is allowed to act. Form TM-48 is that proof. Without it, an agent has no formal authority on your file.

| Point | Details |
|---|---|
| Purpose | Authorises a trademark agent or attorney to act on the applicant's behalf |
| Who signs | The applicant, or an authorised signatory for a firm, LLP, company or other entity |
| Who it names | The registered trademark agent or attorney who will act for you |
| When it is needed | Whenever an agent files or handles proceedings for you |
| Filed with | The Trademark Registry, along with the application or the proceeding |
| Type | General (covers several matters) or specific (covers one named matter) |
Submit Form TM-A and pay the government fee on your behalf.
Get examination reports, notices and hearing dates, and keep you updated.
Draft and file the written reply to an examination report within the time allowed.
Appear before the Registrar and argue your case if a hearing is scheduled.
File a counter-statement and take the matter forward if someone opposes your mark.
Act on renewal and other post-registration filings, if the authorisation covers them.
Lets the agent act for you in more than one application or proceeding, so you do not need to sign a fresh form each time you file a new mark.
Limited to a single named application or proceeding, which gives you tighter control but needs a new form for each matter.
Which one suits you depends on how many marks you plan to file. A business that expects to protect a name, a logo and a tagline usually finds a general authorisation more convenient.
The individual or proprietor signs in their own name.
A partner or designated partner with authority to bind the firm signs for it.
A director or an authorised officer signs on behalf of the company.
An authorised trustee or office bearer signs for the trust or society.
The two forms are often mentioned together, but they do different jobs.
| Aspect | Form TM-A | Form TM-48 |
|---|---|---|
| What it is | The application for trademark registration | The authorisation appointing your agent |
| What it contains | Applicant details, the mark, the class, goods or services, user details | The applicant, the agent and the scope of authority |
| Needed if you file yourself | Yes | No |
| Needed if an agent files for you | Yes | Yes |
An agent without written authorisation has no formal standing to file or respond on your file.
If the authorisation is missing or defective, the filing can be held up until it is corrected.
If an agent cannot act on a notice in time, a reply deadline can pass and put the application at risk.
You can always file and manage an application yourself, in which case no TM-48 is needed. It becomes essential only when you want someone else to handle the file.
You do not need to draft the form yourself. We prepare it as part of our filing work, and you only review and sign.
Send the applicant's name, legal status and address so the form carries the correct details.
The authorisation is drafted naming the applicant and the agent who will act for you.
You check the details and sign the form, as the applicant or as the authorised signatory of your entity.
Send us the signed copy so it can be filed with your application.
The authorisation goes to the Trademark Registry along with your application, so your agent has authority from day one.
We receive Registry notices, reply to objections and track your application through to registration.
The total cost has two parts: our professional filing fee and the mandatory government fee paid to the Trademark Registry.
| Component | Amount |

In practice, yes. It is commonly called the power of attorney for trademark, though it is the Registry's prescribed authorisation form rather than a general-purpose power of attorney.

A director or an authorised officer signs on behalf of the company, and for a firm or LLP a partner with authority to bind the firm signs.
A general authorisation lets the agent act in more than one application or proceeding, while a specific one covers only a single named matter.
