Frequently Asked Questions

What is Form 26QB and has it been replaced by Form 141?

Form 26QB was the challan-cum-statement used to pay TDS on property purchase under Section 194-IA of the Income-tax Act, 1961. For deductions on or after 1 April 2026, the Income-tax Act, 2025 applies and the payment and reporting form is Form 141 (Schedule B).

What is the difference between Form 26QB and Form 141?

Form 26QB belongs to the old Act and Form 141 belongs to the new Act. The 1% rate, the ₹50 lakh threshold, and the 30-day deposit deadline stay the same, but the section is now 393(1), Table Sl. No. 3(i), and the seller certificate is Form 132 instead of Form 16B.

How much does property TDS filing cost with SetupFiling?

Our fee is ₹1000 per certificate and includes the challan for TDS payment, Form 141 filing, and the TDS certificate (Form 132). The TDS amount itself is paid to the government and is not part of our fee.

Do I need a TAN to file Form 141 for property TDS?

No. For purchase of property from a resident seller, the buyer files using their PAN, so a TAN is not required.

What details do I need to share to file Form 141?

Share the PAN and address of the buyer and seller, property address, agreement date, sale consideration, stamp duty value, payment dates and amounts, and any previous acknowledgement number if you are paying in instalments.

What is the due date for Form 141 and Form 132?

Form 141 and the TDS are due within 30 days from the end of the month in which the TDS is deducted. Form 132 is to be issued to the seller within 15 days from the due date of Form 141.

What happens if I file Form 141 late?

Interest applies at 1% per month if TDS is not deducted on time and 1.5% per month if it is deducted but not deposited on time. A late fee of ₹200 per day also applies until the form is filed, capped at the TDS amount.

Is TDS required if the property value is below ₹50 lakh?

No. TDS on property purchase applies when the sale consideration or the stamp duty value, whichever is higher, is ₹50 lakh or more. It does not apply to agricultural land.
