Step 1: Conduct a Trademark Search
Before applying for registration, it’s essential to conduct a thorough search to ensure that the desired trademark is not already in use. This can be done through the official website of the Controller General of Patents, Designs & Trademarks.
Step 2: Prepare the Application
The application must include:
- Applicant’s Details: Name, address, and nationality.
- Trademark Representation: A clear representation of the trademark.
- Goods/Services Classification: Specify the goods or services associated with the trademark.
- Proof of Use: If applicable, include evidence showing how the trademark has been used in commerce.
Step 3: Filing the Application
In Jharkhand, applications are filed online through the official government portal or can be submitted physically at the nearest office handling trademarks. Since Jharkhand does not have its own trademark registry office, applications are forwarded to the Kolkata office for processing.
Step 4: Examination of Application
Once filed, the application undergoes examination by a trademark officer. If any objections arise, the applicant will be notified to respond within a stipulated time frame.
Step 5: Publication in Trademark Journal
If the application passes examination, it is published in the Trademark Journal. This publication allows third parties to oppose the registration if they believe it infringes on their existing trademarks.
Step 6: Registration Certificate Issuance
If no opposition is filed within four months of publication, or if any opposition is resolved in favor of the applicant, a registration certificate is issued. This process can take anywhere from 18 to 24 months.
